1. Statutory & Legal Compliance
Yes. Section 19(c) of the POSH Act 2013 mandates regular employee awareness programs for all employees (permanent, contract, and interns) and specialized capacity-building workshops for Internal Committee (IC) members. Failure to comply can result in fines up to โน50,000 and possible cancellation of operating licences for repeat defaults.
Under the revised Companies (Accounts) Rules, companies required to constitute an Internal Committee must explicitly include a statement in the Director's Annual Report confirming that they have complied with provisions relating to the constitution and training of the IC under the POSH Act.
Under the Digital Personal Data Protection Act, 2023, employees handling customer or colleague personal data must follow clear protocols regarding verifiable consent, purpose limitation, and breach escalation.
